This website is operated by HOSTAL DEL CIELO SAS, a commercial company identified by NIT. 901.717.932-6, domiciled at Calle 55 No. 127-46, Int 108, San Javier La Loma, Medellin, Antioquia, Colombia, who will henceforth be called "HOSTAL DEL CIELO". This document establishes the policies for the use of the website https://www.hostaldelcielo.com/, as well as the conditions for the acquisition of services via the platform available on said website.

By visiting our Site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These terms of use apply to all users of the site, including, without limitation, users who are browsers, vendors, and/or buyers, sellers, customers, merchants and/or contributors of content.

We ask the Visitor and/or User of this Website to read this document in detail and carefully before beginning to explore or use it, each time the Visitor and/or User of the Website, by entering or using the services offered on this website, accepts these general conditions and is bound to respect them. Therefore, if you do not agree with the provisions set forth, please refrain from accessing this site and/or using the information or services provided therein.

All new features, tools, or services added to the website will also be subject to these general terms and conditions.

The graphics, images, texts, designs, compilations, and other content on this website are the exclusive property of HOSTAL DEL CIELO. All trademarks and logos appearing on the page are the property of HOSTAL DEL CIELO or third parties who have authorized us to include these signs. It is expressly forbidden for visitors and/or users to modify, transmit, or use the content of the website for commercial purposes, unless they have received prior, express, and written authorization from HOSTAL DEL CIELO.

The Visitor and/or User assumes full responsibility for any improper or unauthorized use of the Website content protected by intellectual or industrial property regulations; consequently, they must cover damages caused both to HOSTAL DEL CIELO and to the holders of the intellectual property rights of the Website content (The Website Founder: Thomas Quintreau-Musci), for acts committed directly by the Visitor and/or User or by an intermediary with their consent, or by using any other mechanism as an instrument to infringe upon these rights.

The site hostaldelcielo.com aggregates different services, as they are, available to users. It is naturally specified that these must remain honest and demonstrate good faith both towards other users and towards the Developer of the hostaldelcielo.com site. Users and/or visitors are responsible for their conduct and communications when using the Website. They therefore commit to using the Site in compliance with applicable legislation, the conditions set forth herein, public order, and morality. None of the Services are intended for use by persons under eighteen (18) years of age unaccompanied by their parent or legal guardian, or by incapacitated persons. If you are under eighteen (18) years of age and/or do not have the capacity to enter into a contract or reach an agreement with HOSTAL DEL CIELO, please refrain from using the booking features of the website. Minors may, however, access our physical site if accompanied by their parents or legal guardians. HOSTAL DEL CIELO may withdraw or suspend the provision of services to Users who have not complied with the provisions of this document or who have violated the law, morality, or public order at any time and without notice. The exclusion of the user will not imply a waiver of the right to exercise the relevant legal actions for the exercise of liability.

5. Scope of Services and Limitation of Liability

The content of this Website is for informational and practical purposes, allowing the User and/or Visitor to learn about and acquire the services offered by HOSTAL DEL CIELO.

6. Specific Terms of Service

6. a Contractual Process and Booking

The contractual process carried out via the Website includes the following steps :

1. Preliminary Information Phase (Main Website): Upon arrival at the homepage, the visitor freely accesses all information concerning our project, our values, our housing and additional services, our location, and the technical details of our rooms. A direct link directs the user to our internal search engine (Lobby PMS).


2. Selection Phase (Internal Search Engine - Lobby PMS): On this interface, the user views availability and rates in real-time. At this stage, the general terms and conditions of sale (GTC) are already accessible. The user selects the room type, the number of people, and views the total price applicable before entering any personal information.

 

3. Contractual Validation Phase: Before proceeding with the booking, the user enters their personal information. Once again, the general terms and conditions of sale are made immediately available just before they click the final "Book" button.

 

4. Automatic Confirmation Phase: After validation, the client is redirected to an automatic confirmation page that summarizes the booking details and offers direct access to the general terms and conditions of sale. Post-Booking Formalization: The client immediately receives a formal confirmation by email. This message contains the exhaustive detail of their booking, including essential information such as rights of withdrawal, cancellation and refund policies, as well as payment methods and any additional fees.

Once the booking is formalized, the client is therefore invited to examine its content in order to identify any potential material errors in the data entry. If a correction is necessary, the user can call the phone number of the place where the booking was made or send an email to the contact email address, providing the booking identification details.

It is important to remember that the client is solely responsible for the choice of services and their suitability to their needs; HOSTAL DEL CIELO cannot therefore be held responsible for these reasons. Once the booking process is completed, the client will be deemed to have fully accepted it. HOSTAL DEL CIELO considers that the service begins upon booking confirmation. From that moment, the accommodation stock is blocked, the preparation of the experience is activated, and a personalized follow-up is put in place. Therefore, any refund request will be evaluated only according to the conditions of the selected rate.

6. b Guarantee and Booking Method

 

It is specified that, in accordance with our current policy, the booking process via our website requires no entry of banking data (card numbers, security codes, etc.). HOSTAL DEL CIELO S.A.S. has not, to date, implemented an online payment or pre-payment tool. Consequently, the confirmation of the booking is based on a relationship of mutual trust. We rely on the good faith of the client to respect the cancellation and refund conditions detailed in these terms, which were brought to their attention before the validation of their booking. The effective payment of the booked services takes place exclusively upon the client's arrival at the establishment (check-in), once the latter has read and signed the internal regulations as well as the general terms and conditions of sale in their full version, available in our physical register.

6. c Applicable Legislation

The relationship between the website owner and the users will be governed by Colombian law.

6. d Pricing of Services

  • The prices of our services are subject to change without notice. This does not apply to already confirmed bookings, except in the event of changes to legal or regulatory taxes established by the competent authorities.

  • We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice and without giving rise to any compensation.

  • We will not be liable to you or any third party for any modification, price change, suspension, or interruption of the Service. Residents of Colombia must pay a 19% VAT on the value of their stay, an amount that does not appear in the final booking rate. Foreigners and non-resident Colombians will only be exempt from VAT if the purpose of their trip is: to receive medical treatment, rest or leisure activities as a tourist, to attend or participate in cultural, scientific, or sporting events, congresses or business, or groups of tourists in transit on a cruise ship. To do this, the passport must be stamped with the TP code and be valid for 90 days.

  • The Client will be responsible for all consumptions that correspond to them and that occur during their stay.

6. e Payment Methods

During registration and once the booking is verified, HOSTAL DEL CIELO will ask the Client to make the payment by the following means: cash or credit or debit cards issued by Colombian or foreign financial institutions.

The services offered on the Site, unless otherwise indicated for specific cases or offers of certain services, can only be paid for using the means specifically indicated in each case. The Site may specify certain payment conditions depending on the payment method used by the Visitor and/or User.

Cash payment for booked services is accepted without any additional fees. However, in order to offer increased flexibility to our clients, HOSTAL DEL CIELO S.A.S. also offers dematerialized payment solutions via payment links (OpenPay BBVA) or by bank card. In the event that the user opts for one of these payment methods, a 5% commission on the total price of the service will be applied. This information is systematically communicated to the client prior to any transaction. We guarantee total transparency regarding this pricing policy, accessible at any time in our online general terms and conditions and clearly displayed within the establishment, as well as in the physical register signed by the client during check-in (which is always signed before making the payment).

 

6. f Cancellation Policies

  • Right of Withdrawal (Law 1480): 5 working days after booking for a 100% refund (if the service has not yet started).

  • Penalties: 50% of the total amount for a cancellation more than 48 hours in advance. 100% for a cancellation 48 hours or less in advance, or in case of a no-show.

  • Pre-payment: Hostal del Cielo S.A.S. reserves the right to request a security deposit or a pre-payment of 50% to 100% for bookings during periods of high occupancy, long stays, or group bookings that mobilize significant inventory and involve high financial stakes, in order to guarantee the blocking of units.

6. g Late Departure

Additional fees in case of non-compliance with the departure time (11:00 AM):

 

  • 30 min to 1 hour: 25% of the nightly rate.

  • 1 hour to 2 hours: 50% of the nightly rate.

  • More than 2 hours: 100% of the nightly rate.


6. h Entry of Minors

The entry of minors is only authorized when accompanied by their parents (proving the relationship by birth certificate) or a legal guardian duly authorized by an original notarized document. The Hostal strictly complies with Law 679 of 2001 for the prevention of exploitation and sexual abuse of minors. Any suspicious attitude will be reported immediately to the competent authorities.

6. i Prohibition of Sex Tourism

In accordance with Law 679 of August 3, 2001, which establishes provisions to prevent and counter exploitation, pornography, and sex tourism involving minors, and by virtue of Article 17 of said law, HOSTAL DEL CIELO reaffirms its total commitment to the protection of children and adolescents. We formally inform the User that any exploitation or sexual abuse of a minor is punishable by severe criminal sanctions in Colombia. Any suspicious behavior or criminal act will be subject to immediate reporting to the competent authorities.

For more details and information on our commitments, we invite you to consult our Code of Conduct, available in its entirety on our website, as well as on our physical displays and in the check-in register signed by each client upon their arrival.

6. j Liability and Third Parties

We are not responsible for valuables not deposited in safes (locked with a padlock), nor for accidents due to misuse of the facilities. The Hostal acts as an intermediary for external activity services.

6. k Use of Beds and Rooms

The client must occupy exclusively the assigned unit. The use of additional units without authorization will result in a billing of 100% of their value.

6. l Prohibitions, Damages, and Keys

  • Substances and Tobacco (Fine 250,000 COP): Use of drugs, weapons, and introduction of outside alcohol are prohibited. Smoking (cigarettes or vapes) is prohibited inside and in family homes. Non-compliance will result in immediate expulsion without refund, as well as the mandatory payment of a fine of 250,000 COP for violation of the coexistence regulations and child protection.

  • Keys: In case of loss, damage, or departure from the hostal with the keys, the client will pay 25,000 COP or assume the shipping costs for immediate return.

  • Damages: Any damage to the property will be billed according to its commercial replacement cost.

6. m Reception Hours and Access

  • Reception: From 08:00 to 22:00. The Hostal does not have 24/7 reception.

  • Night Check-in: Maximum 23:00 (gate closure)

  • Late Arrival: Must inform before 20:00.

  • Emergency: 24/7 contact available for critical emergencies at 304 293 6334.

6. n Conviviality, Rest, and Hours

  • Mandatory Silence: Between 22:00 and 07:00 (at the hostal or in a family home).

  • Restricted Areas: After 22:00, use of the pool table and television is prohibited. Talking loudly near the rooms is prohibited. In case of late entry, you must strictly respect the sleep of other clients. Non-compliance may lead to the end of the stay without a refund.

  • Meals: Breakfast and meal times are communicated during Check-in and available at the reception. Some dishes require advance ordering.

  • 24/7 Free Access Zone: Our viewpoint, subject to respecting mandatory silence rules, is for people staying at the hostal. For people staying with a host family, it is accessible during reception opening hours.

6. o Use of Kitchens and Service Areas

  • Private Kitchens: Kitchens reserved for staff (main kitchen, La Cumbre 360 restaurant kitchen) are prohibited to clients.

  • Client Kitchen: A small kitchen and a specific refrigerator are made available. Rules: Closing at 21:00. Washing dishes is mandatory immediately after use. Any damage will be billed.

  • Fridges: It is strictly forbidden to help yourself in the Hostal refrigerators (especially the one with drinks for sale). Any consumption must be managed by the staff.

6. p Pets

 

Prohibited unless prior and express authorization from Hostal del Cielo S.A.S.

 

6. q Food

 

  • Breakfast: 08:00 - 10:00 (request the day before for early hours). Lunches/Dinners: You have the following options:
    La Cumbre 360 Menu: You can order from the menu of our partner restaurant.
    > Solidarity Menu / delivery service to the hostal: inquire at the reception for more information on solidarity dishes in partnership with the local community.
    > Kitchen for clients: You can use the small kitchen made available to you, strictly respecting the hours and cleaning rules mentioned previously. Rates: To know the prices of all our services, please consult the price list available at the reception. We also offer a menu (in PDF and paper format) for our restaurant offer.

6. r Use of the Restaurant, Viewpoint, and External Visits

The Hostal has a partner restaurant (La Cumbre 360) and a viewpoint that opens its doors to the public, especially on weekends.

  • Exclusive Areas for Guests: The Hostal has various terraces and private common areas designed exclusively for the rest of our guests. Access to these areas is strictly forbidden to external visitors, thus ensuring the privacy and safety of those staying with us.

  • Restaurant Access: The restaurant and main viewpoint space can be used by guests throughout the day. However, during public service hours — mainly Fridays, Saturdays, and Sundays from 16:00 to 23:00 — the consumption areas will be reserved primarily for restaurant operations. In accordance with current standards, we strictly respect capacity limits (aforo), with a room allowing for groups of 15 to 20 people maximum during the mentioned time slots.

  • External Visits: Entry of persons external to the Hostal is permitted only during the restaurant's public opening hours or with prior authorization from the reception for authorized areas. Any visitor must be of legal age and respect the internal regulations. Non-compliance with these standards will be grounds for immediate expulsion.

  • Access to private areas: Formal prohibition for non-registered persons to access accommodation areas. Sanctions: Immediate expulsion without refund and mandatory fine of 200,000 COP for serious violation of safety and coexistence regulations.

6. s "Call me Mami Hostal" Service

  • Guarantee: 100% pre-payment via OpenPay BBVA payment link (non-refundable).

  • Conduct: We reserve the right to cancel the service and remove the client immediately for any lack of respect or violence towards families.

  • Price: Hostal del Cielo S.A.S. acts as an intermediary and issuer of the invoices corresponding to the accommodation service. The price paid to the Hostal includes exclusively the overnight/accommodation service. The pre-payment is collected by Hostal del Cielo S.A.S. (via the OpenPay payment link, including a 5% commission in case of using foreign cards depending on the exchange rate in effect). A portion of this amount is then transferred to the host family.

  • Food and Logistics: For everything related to food, the client must organize directly with the family (agreements on kitchen use, sharing grocery/shopping expenses, etc.).

  • Special Check-in: Entry into the family home takes place at 16:00. Each check-in must be done at the Hostal del Cielo reception, prior to access to the house.

  • Conduct and Safety: The building is a family home. Exemplary conduct is required. Any lack of respect towards the family, minors, neighbors, or other clients is grounds for immediate expulsion without refund (Law 1336 of 2009).

  • Responsibility for Personal Objects: The client is solely responsible for the safekeeping of their personal belongings within the family home. Hostal del Cielo S.A.S. is not responsible for losses or damages to personal objects.

  • Access: The client will have 24-hour access via the provision of a duplicate set of keys, but must respect the mandatory silence from 22:00 to 08:00 (in accordance with the Eighth Clause of the subcontracting contract).

  • Prohibition of Substances and Conduct:

> It is strictly forbidden to consume alcohol, tobacco, or illicit substances inside the family home, due to the presence of minors and the family nature of the household.
Likewise, it is forbidden to stay in the property if the client is under the influence of narcotics or in a state of drunkenness, even if the consumption took place outside the establishment.

> Non-compliance with this rule will result in immediate and final expulsion without the right to a refund. Visits: It is strictly forbidden to introduce visitors or persons not included in the booking into the family home. Any exception requires the prior and express agreement of both Hostal del Cielo S.A.S. and the hostess.

> The client accepts that the common areas of the dwelling may be shared with other people or travelers invited by the Hostal for cultural activities or food services.

> Commercial Exclusivity: It is strictly forbidden for the client to negotiate rates or agree on future bookings directly with the host family. Any booking or additional service must be managed exclusively via Hostal del Cielo S.A.S.
